1. Agreement and scope
These Terms of Service ("Terms") govern access to and use of the Game Pulse website, the Game Pulse service at app.game-pulse.pro, and the Game Pulse Discord application and other integrations (together, the "Service"). The Service is operated by HeroCraft Ltd, Capital Center, 9th Floor, 2-4 Arch. Makariou III Avenue, 1065 Nicosia, Cyprus ("HeroCraft", "we", "us").
The Service is a business tool for game studios and publishers. It is provided to organizations ("Customer") and to the individuals the Customer authorizes to use its account ("Users"). By creating an account, using the Service, or adding the Game Pulse application to a Discord server, you accept these Terms on behalf of the Customer you represent and confirm that you have authority to do so.
The Service may also be provided under an order form, proposal or other agreement accepted in writing by HeroCraft and the Customer ("Order"). If an Order conflicts with these Terms, the Order prevails for the Service it covers.
Members of a Discord community whose messages are processed through the Service are not parties to these Terms by reason of that processing. How their information is handled is described in the Game Pulse Privacy Policy.
2. Accounts and access
Accounts are created for Users by HeroCraft or by the Customer's administrators. The Customer is responsible for the accuracy of account information, for keeping credentials confidential, for the roles and project access it grants, and for all activity under its accounts. Notify us promptly at info@game-pulse.pro of any unauthorized access.
3. Connected sources, including Discord
The Service collects feedback from sources the Customer connects, such as Discord servers, app stores, Steam, Telegram and support systems. For each connected source, the Customer represents that it has the rights, permissions and authority needed to connect it and to have its content processed as described in the Privacy Policy, and that it will comply with the terms and policies of that source.
The Game Pulse Discord application may only be added to a server by a person with authority to manage that server. The Customer controls which channels the application can read and is responsible for informing its community about the use of Game Pulse where required. Use of the Discord application is also subject to Discord's Terms of Service and Developer Policy. Game Pulse is not affiliated with or endorsed by Discord.
Third-party sources are not under our control. Changes to their APIs, permissions, rate limits or availability can interrupt or limit collection, and we are not responsible for such changes.
4. Acceptable use
You must not:
- Use the Service in violation of applicable law or the rights of others, or connect sources you are not authorized to connect.
- Use the Service to harass, profile for discriminatory purposes, or take action against individual community members based on sensitive characteristics.
- Sell, rent or disclose community content obtained through the Service to third parties, except as permitted by the source's terms and applicable law.
- Attempt to access data of other customers, bypass access controls, or probe, scan or disrupt the Service.
- Reverse engineer the Service, or use it to build a competing product.
- Share account credentials or give Service access to people outside the Customer's authorized Users.
We may suspend access that we reasonably believe breaches this section or puts the Service, other customers or community members at risk. Where practical, we will notify the Customer first.
5. Customer data and AI processing
As between the parties, the Customer retains its rights in the content collected from its connected sources and in the content it submits ("Customer Data"). The Customer grants HeroCraft a non-exclusive right to host, copy, process and display Customer Data to provide, secure and support the Service for that Customer.
The Service uses AI models to classify, translate, summarize and answer questions about feedback. Customer Data is sent to AI model services for this purpose, as described in the Privacy Policy, which forms part of these Terms. HeroCraft prohibits using Discord message content to train or fine-tune AI or machine-learning models within its own organization.
AI-generated results can be inaccurate or incomplete. The Customer is responsible for reviewing results against the underlying feedback before relying on them.
Deletion and opt-out requests are handled as described in the Privacy Policy. Removing the Discord application or disconnecting a source stops future collection; it does not by itself delete data already stored.
6. Fees and orders
Fees, billing periods, payment terms and any usage limits for the Service are set out in the applicable Order. No fees are payable unless agreed in an Order.
Fees are exclusive of taxes, which the Customer is responsible for, other than taxes on HeroCraft's income. Unless the Order states otherwise, fees are non-refundable except where required by law. If undisputed fees remain unpaid after their due date, we may suspend the Service after giving the Customer written notice and at least 14 days to pay.
Any change to fees takes effect only at the start of a new billing period or renewal term, and only after written notice to the Customer before that period begins.
7. Pilots, trials and beta features
Pilots, trials, evaluations, free access and features marked as beta or experimental are provided "as is", without any service-level commitment, for the period stated in the Order or communicated by us in writing. We may change, limit or end them at any time.
8. Intellectual property and feedback
HeroCraft and its licensors own the Service, including its software, design and documentation. Subject to these Terms and any Order, we grant the Customer a non-exclusive, non-transferable right for its Users to use the Service for the Customer's internal business purposes during the term.
If you send us suggestions about the Service, we may use them without obligation to you.
9. Changes, suspension and termination
We continuously develop the Service and may add, change or remove features. We will not materially reduce the core functionality of a paid Service during a paid term covered by an Order.
Either party may stop using or providing the Service as set out in the applicable Order. Where there is no Order, either party may terminate at any time by notice; the Customer may also stop by removing the Discord application and disconnecting its sources. Either party may terminate for the other's material breach that is not cured within 30 days of notice.
After termination, access to the Service ends. The Customer may request deletion of its Customer Data at info@game-pulse.pro; requests are handled as described in the Privacy Policy, and existing database backup copies are not modified individually. Sections 5, 6 (for amounts due), 8, 10, 11 and 13 survive termination.
10. Disclaimers
Except as expressly stated in an Order, the Service is provided "as is" and "as available". To the extent permitted by law, HeroCraft disclaims all implied warranties, including merchantability, fitness for a particular purpose and non-infringement, and does not warrant that the Service will be uninterrupted, error-free, or that every relevant message, issue or incident will be collected or detected.
11. Limitation of liability
To the extent permitted by law, neither party is liable for indirect, incidental, special or consequential damages, or for lost profits, revenue or goodwill, arising out of or relating to the Service or these Terms.
To the extent permitted by law, each party's total liability arising out of or relating to the Service or these Terms is limited to the greater of (a) the fees paid or payable by the Customer to HeroCraft for the Service in the 12 months before the event giving rise to the claim and (b) EUR 100.
These limits do not apply to the Customer's payment obligations, a breach of Section 4, or liability that cannot be limited under applicable law, including liability for fraud, wilful misconduct, gross negligence, or death or personal injury caused by negligence.
12. Changes to these Terms
We may update these Terms. The version published at https://game-pulse.pro/terms applies from its publication date. For material changes, we will notify Customers with active accounts by email or in the Service at least 14 days in advance, unless the change is required by law. Continued use after a change takes effect means acceptance of the updated Terms. Changes do not alter the terms of an Order during its current term.
13. Governing law and contact
These Terms and any dispute arising out of or relating to them are governed by the laws of the Republic of Cyprus. The courts of Nicosia, Cyprus have exclusive jurisdiction, unless mandatory law provides otherwise.
